The family of one of Dwight Howard’s mothers has filed a lawsuit for unlawful death, claiming that a broken toilet bowl led to her untimely death.

Melissa’s son Rios and his grandmother are suing a rental apartment company in Calabasas, claiming she slipped on the water from a broken toilet bowl, leading to her death.

Melissa was only 31 when she died on March 27, 2020, leaving her 6-year-old son David, who was living with his NBA star father in Atlanta, Georgia, when she died.

According to legal documents obtained by Explosionson of Dwight and Melissa, David, is suing along with his grandmother Edelmira Vega Rias for his unlawful death, claiming the company ignored serious plumbing problems at his late mother’s apartment.

Plaintiffs accuse the management company of ASN Calabasas of failing to repair a broken toilet in her apartment, causing “unsafe conditions” and other factors that led to her death.

“These factors include, but are not limited to, the following: a dangerously broken and / or damaged toilet bowl and / or hose and / or supply or similar plumbing component that has not been properly installed, serviced, cleaned and / or protected in the specified property cause [Melissa] to receive bodily injuries, ”the lawsuit reads.

Previous reports have said Melissa’s death was the result of an epileptic seizure at home. A copy of Melissa’s death certificate is attached to the lawsuit, and the cause of death is listed as “deferred.”

In 2020, the Los Angeles Lakers star spoke about the tragic death of Rios, saying: “There have been some things in my personal life that have been difficult to deal with. My son’s mother, she died a month and a half ago, I find it very difficult to understand how talk to my 6-year-old son about the whole situation. “

Interestingly, Edelmira filed a petition asking the court to order Howard to give her the right to visit after her daughter’s death. Some states recognize the right of grandparents to date their grandson.

Edelmira said she has been David’s main caregiver since he was born and wanted to see him regularly.

David is in the custody of his father Dwight Howard, who has at least 5 children from five women.
